This Privacy Policy explains how Mary Consulting ELD (“Mary Consulting”, “we”, “us”) collects, uses and shares information when you use the Mary Consulting ELD electronic logging device, the Mary Consulting ELD mobile application, our fleet web portal, our website and our support services (together, the “Service”). An electronic logging device necessarily records where a commercial vehicle is and when it is being driven; this policy describes that data and the limits on how we use it.
1. Who we are and what this covers
Mary Consulting ELD, located at 2375 East Arizona Biltmore Circle, Phoenix, AZ 85016, is the provider of the Service and the party responsible for the information described in this policy. The Service is used by motor carriers (“Carriers”) and by the drivers they employ or contract with. In most cases the Carrier decides which drivers and vehicles use the Service and has access to the resulting records; if you are a driver, your Carrier is your first point of contact for questions about the records it keeps about you.
This policy does not cover the practices of your Carrier, of the Apple App Store or Google Play, or of any website we link to.
2. Information we collect
Information you or your Carrier provide
- Carrier account information: company name, USDOT number, address, time zone, contact name, phone number, email address and billing details.
- Driver profile: name, driver's licence number and issuing state, ELD username, email address, phone number, home terminal and assigned vehicles. Federal ELD rules require certain of these fields to appear in the records of duty status.
- Vehicle information: unit number, VIN, licence plate and the ELD device serial number connected to the vehicle.
- Content you create in the app: duty status changes, log annotations and edit requests, certifications, DVIR entries including defects, photos and signatures, notes to the office and messages to support.
Information recorded automatically by the ELD
- Engine and vehicle data read from the vehicle's engine control module: engine power status, engine hours, odometer, vehicle speed and diagnostic data such as fault codes.
- Location data from the ELD device and, where enabled, from the mobile device, recorded at each change of duty status, at engine power-up and shut-down, at 60-minute intervals while the vehicle is in motion and at the start and end of personal use or yard moves. Location precision is reduced to approximately a one-mile radius during authorized personal use, as the ELD rule requires.
- Hours-of-service events such as driving time, on-duty and off-duty time, malfunction and data diagnostic events, and unidentified driving records.
Information about the app and the device you use
- Mobile device model, operating system version, app version, language, Bluetooth and network status, unique app installation identifiers and crash or performance logs.
- When you visit our website: IP address, browser type, pages viewed and referring page. Our website uses only cookies that are strictly necessary for it to work.
3. How we use information
We use the information described above to:
- provide the Service, including recording and displaying hours of service, generating records of duty status and DVIRs, and syncing records between the device, the app and the web portal;
- make records available to your Carrier so that it can supervise compliance, review and approve edits, resolve unassigned driving time and generate reports such as HOS and IFTA summaries;
- transfer records to the Federal Motor Carrier Safety Administration (“FMCSA”) or display them to an authorized safety official when a driver initiates a transfer or inspection through the app;
- send alerts and notifications about upcoming hours limits, malfunctions, required certifications and account activity;
- provide customer support and respond to your requests;
- manage billing, subscriptions and hardware orders;
- maintain the security and integrity of the Service, prevent tampering and fraud, and troubleshoot problems;
- analyze usage in aggregated or de-identified form to improve reliability and features; and
- comply with legal obligations, including record-keeping and audit requirements that apply to ELD providers.
We do not use ELD data to build advertising profiles and we do not show third-party advertising in the Service.
4. How we share information
- With your Carrier. Drivers' records, location history, DVIRs and app activity are visible to the Carrier that manages the account. This is inherent to how an ELD works and is required by federal rules.
- With FMCSA and law enforcement. When a driver initiates a transfer during a roadside inspection, records are sent to FMCSA through its web service or email transfer method. We may also disclose information when required by law, subpoena, court order or a lawful request from a government authority, or where we believe disclosure is necessary to protect safety or our legal rights.
- With service providers. We use trusted vendors to host and operate the software platform behind the Service, store data, deliver push notifications, process payments, send email and provide analytics and crash reporting. They may process information only on our instructions and for the purposes described in this policy.
- With hardware partners. Device manufacturers may receive device identifiers and diagnostic information needed to support and update the hardware.
- In a business transfer. If we are involved in a merger, acquisition, financing or sale of assets, information may be transferred as part of that transaction, subject to this policy.
We do not sell personal information, and we do not share it with third parties for their own marketing.
5. Location data
Precise location is essential to the Service and is recorded automatically as described in Section 2. The mobile application requests location permission so that it can complete records when the ELD device is temporarily unavailable and to support features such as maps and geofence alerts. If you deny or revoke location permission the ELD device will continue to record location on its own, but some app features may not work and your records may contain data diagnostic events. Location recorded during authorized personal conveyance is stored at reduced precision and is not made available to the Carrier at full precision.
6. Data retention
Federal rules require Carriers to keep records of duty status and supporting documents for at least six (6) months, and we keep ELD records available in the web portal for at least that long. Carriers may choose a longer retention period under their subscription. Account and billing information is kept for as long as the account is active and afterward for as long as needed to meet legal, tax and accounting obligations. Support communications and diagnostic logs are kept for a limited period and then deleted or de-identified. When your subscription ends you may export your records for thirty (30) days, after which we delete or anonymize them in the ordinary course of business unless the law requires us to keep them.
7. Security
We protect information using measures appropriate to its sensitivity, including encryption of data in transit, encrypted storage, access controls that limit staff access to what their role requires, logging of administrative access and regular backups. ELD records carry the integrity checks required by the FMCSA technical specifications so that edits can always be traced. No system is completely secure; if we learn of a breach that affects your information we will notify you and your Carrier as required by law.
8. Your choices and rights
- Access and correction. Drivers can view their own records in the app and can request corrections through the annotation and edit-request features; the original record is always preserved, as the ELD rule requires. Carriers can view and export their data in the web portal.
- Notifications. You can manage push notifications in your device settings. Some compliance alerts cannot be turned off while the app is in use because they are part of the ELD function.
- Permissions. You can change location, camera and Bluetooth permissions in your device settings, with the consequences described in Section 5.
- Deletion. Because HOS records are legally required to be kept, we cannot delete them at a driver's request while the retention period is running. Requests to delete other personal information can be sent to info@maryconsultingeld.com. Drivers should direct requests about their records to their Carrier, which controls the account.
We will respond to requests within the time required by applicable law and may need to verify your identity before acting on them.
9. California residents
If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) may give you the right to know what personal information we collect and how it is used and shared, to request deletion or correction of personal information, to opt out of the sale or sharing of personal information, and not to be discriminated against for exercising these rights. We do not sell personal information or share it for cross-context behavioral advertising. Much of the information we process about drivers is processed on behalf of their Carrier as a service provider, and in those cases we will refer your request to the Carrier. To exercise your rights, contact us at info@maryconsultingeld.com or (602) 634-8915. You may designate an authorized agent to make a request on your behalf.
10. Children
The Service is intended for commercial drivers and motor carriers and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with information, contact us and we will delete it.
11. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page with a new effective date and, where the change is material, notify Carriers by email or through the web portal before it takes effect.
